Safeguarding the rights of children<\/strong><br \/>The United Nations Convention on the Rights of the Child (UNCRC) aims to ensure optimal development, a happy childhood and a promising future for all children. This convention was signed by nearly every country in the world, including the Netherlands. This means that all our laws, regulations and policies \u2013 both in the European and the Caribbean Netherlands \u2013 must be designed to protect the rights of children, both now and in the future.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b0600c2 elementor-widget elementor-widget-spacer\" data-id=\"b0600c2\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-fea72a6 elementor-widget__width-initial elementor-widget-tablet__width-inherit elementor-widget elementor-widget-text-editor\" data-id=\"fea72a6\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>This guide offers practical advice on how to put children\u2019s rights first when developing new laws, regulations and policies.<\/p><p>The <span style=\"text-decoration: underline;\"><a href=\"https:\/\/wetten.overheid.nl\/BWBV0002508\/2002-11-18\" target=\"_blank\" rel=\"noopener\">UNCRC<\/a><\/span> consists of 54 articles designed to ensure that all children have a happy childhood and can develop to their full potential. The following four articles, known as the \u2018general principles\u2019, form the backbone of the UNCRC:<\/p><p><strong>Article 2 \u2013 No discrimination<\/strong><br \/>All the rights outlined in the UNCRC apply equally to all children, with no exceptions. This article specifically prohibits treating certain children differently due to factors like their ethnicity, sexual orientation or gender.<\/p><p><strong>Article 3 \u2013 Best interests of the child<\/strong><br \/>The interests of children must come first in all decisions that affect them, including when developing and implementing new laws and policies.<\/p><p><strong>Article 6 \u2013 Life, survival and development<\/strong><br \/>Every child has an inherent right to life and to develop to their full potential. This means that children must be allowed to grow and develop in all aspects of their lives, both now and in the future. For this to happen, children need a safe, nurturing living environment. Governments must strive to provide the right conditions for all children to thrive<\/p><p><strong>Article 12 \u2013 Respect for children\u2019s views<\/strong><br \/>Children have the right to express their opinions on issues and decisions that affect them. This means that children should be involved in decision-making processes and that their views should be taken seriously.<\/p><p>These four articles are all interconnected. The Committee periodically makes recommendations to the Dutch government on how to improve children\u2019s rights in the Netherlands. For example, it recommends using a CRIA to ensure that children\u2019s best interests are always taken into account when developing new laws, regulations and policies.<\/p><p><strong>General Comment 14 and General Comment 12<\/strong> contain important guidance on the form and content of a CRIA. General Comment 14 explains how to clearly identify children\u2019s best interests, as well as how to involve children in this process. This document emphasises the importance of considering children\u2019s overall development and provides a framework for understanding children\u2019s rights and how they are interconnected. The seven elements are connected to many of the rights listed in the UNCRC. By conducting a CRIA at the earliest stage possible, we can safeguard children\u2019s rights and ensure they are not undermined by future laws, regulations or policies.<\/p><p>If the Preliminary Check indicates that your proposal will not affect children\u2019s rights, you do not need to conduct a CRIA.
